• Motorway User Trials: Privacy Notice for trial participants

    This Privacy Notice explains how we collect and use data that you provide to us during the course of the Motorway User Trials.

TRL Ltd is the Data Controller for the purposes of the Data Protection Act 2018 and the General Data Protection Regulation (Regulation (EU) 2016/679).

What data will be collected for this research?

The lawful basis for using your information

The lawful basis for us collecting and using your personal data for this research (full name, telephone number, email address, video footage of you, and GPS data) is your consent, which we obtain through online surveys that we invite you to complete.

What will happen with the information you provide

Any of your personal data collected by TRL for this research will be kept private and processed in accordance with the EU General Data Protection Regulation (GDPR). Any paper records of your personal data will be kept in a locked file or transferred to an electronic, password-protected file before being securely destroyed. Electronic files containing participants’ personal data are accessible only to members of the TRL Motorway User Trials Team who need to access them.

All data will be anonymised and we will not share your personal data with anyone else, including our client, Highways England. Your personal data will not be transferred outside the European Economic Area. The anonymised findings from this research will be shared with Highways England to help them inform future policy.

The length of time we keep your information

Your personal data will be held until the end of the project (due Novvember 2019) for the purpose of data analysis and contacting you about the research. Once the project has been closed, personal data will be securely deleted or destroyed.

How we keep your information secure

We take your privacy very seriously; a range of technical measures are in place to control and safeguard access to, and use of, personal information. TRL staff members with access to the personal data are required to complete data protection training on an annual basis.

You have the following rights in relation to the collection and use of your personal data for this research:

  • The right of access; if you would like a copy of your personal data, please contact us.
  • The right to rectification; if you would like to rectify any of your personal data, please contact us.

  • The right to restrict processing; if you would like us to restrict or suppress the processing of any of your personal data, please contact us.
  • The right to data portability; if you would like us to provide you with a copy of your personal data in a structured, commonly used, and machine-readable format, please contact us.
  • The right to object; if you would like to object to the processing of your personal data, please contact us.
  • Rights in relation to automated decision making and profiling; the surveys we will ask you to complete before the trial begins involve automated decision making to assess your eligibility for this research, based on your survey responses. In addition, face reader software will be applied to the video footage of you to analyse movements you made while driving (e.g. head movement and facial expressions) to profile your responses to the driving environment.  We do not believe the process of, or results from, the automated decision-making or profiling used for this project will have any significant or legal effects on you. Please remember that you are not obligated to take part in this research and you are free to withdraw at any time during the study without providing a reason by emailing your withdrawal request to motorways@trl.co.uk.
